Types of Turkish Residence Permits
Under Law No. 6458 on Foreigners and International Protection, Turkish legislation provides six main categories of residence permits.
1. Short-Term Residence Permit
Short-term residence permits may be available to foreign nationals who meet the relevant legal requirements for purposes including tourism, ownership of residential property, business connections, scientific research, and certain other activities.
A short-term residence permit is generally issued for a maximum of two years at a time, subject to statutory exceptions and the assessment of the competent authorities.
2. Family Residence Permit
Family residence permits may be available to qualifying foreign spouses, children, and dependent children of Turkish citizens or eligible foreign sponsors.
Applications are subject to legal requirements concerning family relationships, the sponsor's status, income, health insurance, accommodation, and other relevant conditions.
3. Student Residence Permit
Foreign nationals studying at eligible educational institutions in Turkey may apply for a student residence permit where required.
The applicable requirements depend on the educational programme, the student's circumstances, and the relevant immigration legislation.
4. Long-Term Residence Permit
Foreign nationals who meet the statutory conditions, including the required period of lawful residence in Turkey, may qualify for a long-term residence permit.
Long-term residence permits are issued for an indefinite period, subject to the relevant legal provisions.
5. Humanitarian Residence Permit
Humanitarian residence permits may be issued in exceptional circumstances specified under Turkish immigration legislation.
6. Residence Permit for Victims of Human Trafficking
Turkish law also provides a special residence permit category for victims or suspected victims of human trafficking, subject to the applicable statutory conditions.
Residence Permit in Turkey Through Property Ownership
Foreign nationals who own qualifying residential property in Turkey may be eligible to apply for a short-term residence permit based on property ownership.
The property must satisfy the applicable legal requirements, including requirements concerning its residential nature, use, location, and value where relevant.
Property-related residence permit applications may be subject to minimum valuation thresholds and administrative requirements that vary according to the date of acquisition and applicable rules.
Purchasing real estate in Turkey does not automatically guarantee the issuance or renewal of a residence permit.
SD Law Office provides legal assistance concerning property-based residence permit applications and the assessment of relevant documentation.
Foreign nationals considering property investment may also review the separate legal requirements for Turkish citizenship by investment.
Tourist Residence Permit in Turkey
Foreign nationals wishing to remain in Turkey for tourism purposes may apply for a short-term residence permit where the relevant legal requirements are satisfied.
Applicants may be required to provide information concerning their intended stay, accommodation, financial circumstances, health insurance, and other supporting documents.
Each application is assessed according to the applicable legislation and the applicant's individual circumstances.
Turkish Residence Permit Renewal
Foreign nationals who wish to extend an existing residence permit must follow the applicable renewal procedures and filing deadlines.
Renewal applications may require updated documentation concerning the purpose of residence, accommodation, insurance, financial circumstances, and other relevant conditions.
An existing residence permit does not automatically guarantee its renewal.
Work Permit in Turkey
A Turkish residence permit does not, by itself, authorize a foreign national to work in Turkey.
Foreign nationals who intend to work in Turkey generally need an appropriate work permit or a legally recognized exemption.
Work permit applications are governed by the relevant Turkish labour and immigration legislation, and the applicable procedure depends on the foreign national's circumstances and the nature of the proposed employment.
A valid work permit generally also serves as a residence permit during its validity, subject to applicable statutory provisions.
SD Law Office provides legal consultancy concerning work permit applications and related administrative procedures.
Residence Permit Rejection and Legal Remedies
Residence permit applications may be refused or existing permits may be cancelled or not renewed where the relevant legal conditions are not satisfied.
Foreign nationals affected by such decisions may have access to administrative or judicial remedies, depending on the nature of the decision and applicable procedural deadlines.
Legal assessment of the decision and its notification is important when determining the available remedies.
