COLLECTION OF RECEIVABLES OF FOREIGN CITIZENS IN TURKEY

1-Do foreign citizens have the right to file a lawsuit and perform enforcement proceedings to collect their receivables in Turkey?

Foreign individuals and legal entities have the right to file a lawsuit and conduct enforcement proceedings to collect their receivables in Turkey. However, foreign individuals and legal entities must deposit if they want to file a lawsuit or initiate enforcement proceedings in Turkey. This obligation is covered by the Law on Private International Law and Procedural Law (MÖHUK) within the scope of clause forty-eight. It says as follows:

“Foreign individuals and legal entities who file a lawsuit in a Turkish court, participate in a lawsuit, or are engaged in enforcement proceedings must show the collateral that the court will determine to cover the damages and losses of the counterparty with the costs of trial and follow-up.”

The exception to this collateral obligation for foreigners is in clause forty-eight. in the second paragraph. Accordingly; “The court exempts the plaintiff, the participant in the case or the executor from collateral based on reciprocity.” With this provision, it has been decided that foreigners are considered as reserved from collateral within the framework of the “reciprocity principle.”

Foreigners who have deposited the necessary collateral following the Law on Private International Law and Procedural Law, as well as foreign citizens who are exempt from depositing warrants have the right to file a lawsuit and perform enforcement proceedings to collect their receivables in Turkey.

2-In which ways will foreigners apply for collecting their receivables?

Foreigners and Turkish citizens could file a lawsuit in Civil Courts to collect their receivables and conduct enforcement proceedings. According to the specifics of the issue, they can file a lawsuit in Civil Courts. Enforcement proceedings are conducted in the enforcement department. According to Turkish legal legislation, it is always crucial to know which legal process is preferable.

3-Is it mandatory to have a lawyer in receivables cases or enforcement proceedings?

According to the legal legislation in Turkey, foreigners do not have to collaborate with a lawyer when filing a lawsuit or performing enforcement proceedings to collect their receivables. However, the collection of the receivables must be a quick process in a fleeting time. The legal actions that are performed correctly and the actions which are taken to avoid any loss of rights are detected by a lawyer from the beginning to the end.
