Residence Permit in Turkey: Types, Requirements and Application Process

Foreign nationals who wish to stay in Turkey beyond the period permitted by their visa or visa exemption generally need to obtain a residence permit, unless they have another legal basis for their stay.

A Turkish residence permit allows foreign nationals to reside legally in Turkey for an authorized period and purpose. However, a residence permit does not automatically grant the right to work. Employment generally requires a separate work permit or a legally recognized exemption.

Who Needs a Residence Permit in Turkey?

Foreign nationals planning to remain in Turkey beyond their permitted visa or visa-exemption period may be required to apply for a residence permit.

The permitted duration of stay depends on the individual's nationality, visa status, and applicable immigration rules. The general visa or visa-exemption limit is commonly 90 days within a 180-day period, although shorter limits and exceptions may apply.

Residence permit applications must be submitted in accordance with the applicable procedures and deadlines.

What Are the Types of Turkish Residence Permits?

Under Law No. 6458 on Foreigners and International Protection, there are six main types of residence permits in Turkey.

1. Short-Term Residence Permit

Short-term residence permits may be available to foreign nationals staying in Turkey for legally recognized purposes, including:

• Tourism

• Ownership of qualifying residential property

• Business or commercial connections

• Scientific research

• Medical treatment

• Certain educational or training activities

A short-term residence permit may generally be issued for up to two years at a time, subject to statutory exceptions and the applicant's circumstances.

2. Family Residence Permit

Family residence permits may be granted to eligible foreign spouses, children, and dependent children of Turkish citizens or qualifying foreign sponsors.

Applications are subject to requirements concerning family relationships, income, accommodation, health insurance, and the sponsor's legal status.

3. Student Residence Permit

Foreign nationals enrolled in qualifying educational programmes in Turkey may apply for a student residence permit where required.

The duration and conditions depend on the educational programme and the applicable legislation.

4. Long-Term Residence Permit

Foreign nationals who have lawfully resided in Turkey for the required period, generally at least eight years of qualifying residence, may be eligible for a long-term residence permit if they meet the additional statutory conditions.

Long-term residence permits are issued for an indefinite period.

5. Humanitarian Residence Permit

Humanitarian residence permits may be issued in exceptional circumstances specified under Turkish immigration legislation.

6. Residence Permit for Victims of Human Trafficking

Turkish law provides a separate residence permit category for victims or suspected victims of human trafficking.

How to Apply for a Turkish Residence Permit

Residence permit applications are generally initiated through Turkey's official e-Residence Permit system.

Depending on the type of application, the applicant may need to submit:

• A valid passport or recognized travel document

• The completed residence permit application form

• Biometric photographs

• Information or documentation concerning accommodation

• Valid health insurance, where required

• Evidence of sufficient financial means, where applicable

• Documents supporting the purpose of residence

• Other documents requested by the competent authorities

The required documentation varies according to the residence permit category and the applicant's individual circumstances.

Residence Permit Through Property Ownership

Foreign nationals who own qualifying residential property in Turkey may be eligible to apply for a short-term residence permit.

For properties acquired on or after 16 October 2023, a minimum property value requirement of USD 200,000 generally applies to property-based residence permit applications. Earlier acquisitions may be subject to different requirements and transitional rules.

The property must satisfy the applicable legal and administrative conditions.

Purchasing residential property does not automatically guarantee the issuance or renewal of a residence permit.

Can Foreign Nationals Work with a Turkish Residence Permit?

A residence permit does not, by itself, authorize a foreign national to work in Turkey.

Foreign nationals wishing to undertake employment generally need an appropriate work permit or a legally recognized exemption.

A valid Turkish work permit generally also serves as a residence permit during its validity, subject to applicable legislation.

Turkish Residence Permit Renewal

Foreign nationals who wish to continue residing in Turkey after their existing residence permit expires must comply with the applicable renewal procedures and deadlines.

Renewal applications are assessed according to the relevant legal requirements. Holding a previous residence permit does not guarantee approval of an extension.

What Happens If a Residence Permit Application Is Rejected?

A residence permit application may be refused if the statutory requirements are not satisfied.

Depending on the decision and the circumstances, the applicant may have access to administrative or judicial remedies.

The reasons for refusal, notification date, and applicable legal deadlines should be assessed individually.
