Within the scope of article 13 of the "Capital Movements Circular" of the Central Bank of the Republic of Turkey and the Capital Movements Circular, implementation instruction and implementation regulation on the Sale of Foreign Currency to the Central Bank of the Republic of Turkey and according to the Turkish Citizenship Law, the Central Bank is obliged to exchange foreign currency in transactions in which foreigners are buyers.
According to the regulation, the technical details of which are explained in the texts of the circular, foreigners will first have to sell their foreign currency to the Central Bank through the bank and then submit the Foreign Exchange Purchase Certificate issued by the bank to the land registry office. This practice has entered into force as of January 24, 2022, and a foreign currency purchase certificate is required for real estate acquisitions by the applicant. After meeting with the real estate lawyer, the applicant needs an expert who will evaluate the value of the real estate and prepare a survey report. The real estate attorney will then investigate whether there is a mortgage on the real estate and whether it has a license from the municipality. The property attorney can arrange for a secure form of payment to complete the transaction quickly and legally. Title deed sales tax is 4% of the real estate value. After the applicant gets the title deed from the land registry office, they become the legal owner of the real estate. Property sales tax is 3% of the declared value of the property specified in the survey report. As soon as the applicant gets the title deed, they become the legal owner of the real estate. After the real estate is purchased compulsory earthquake insurance is taken out as the first process. Subscriptions process for water and electricity are then made by the applicant.
In addition, it is also possible to sign a “sales promise agreement” in the presence of a notary before the official sale. There is no legal validity of sales promise agreements that cannot make at a notary.
